1. Introduction

These Terms and Conditions govern the access to and use of the PoY — Power of You (“PoY”) website, as well as the assessment and coaching session booking platform made available by PoY. By accessing the website or platform and/or purchasing services through these channels, the user fully accepts these Terms and Conditions. Users are therefore advised to read them carefully.

2. Nature and Scope of Information

The information provided on the PoY website is for informational purposes only, presenting its activities, values, areas of expertise, collaboration opportunities, and available coaching services.
The purchase of assessments and coaching sessions is carried out through the PoY platform and is governed by these Terms and Conditions and by the specific policies set out in the following sections.
PoY reserves the right to modify or update, at any time and without prior notice, the contents and functionalities of the website and platform.

3. Use of the Website and Platform

Access to the website is available to any user, although certain areas or functionalities may be restricted to partner companies, entities maintaining a formal relationship with PoY, or registered users of the assessment and coaching session platform.

The user undertakes to:

• Use the website, platform, and respective content responsibly, lawfully, and in accordance with accepted market practices;
• Refrain from any actions that may compromise the security, integrity, or operation of the website or platform;
• Not use any information or content from the website or platform without PoY’s prior express authorization.

4. Purchase of Coaching Sessions

The assessments and coaching sessions made available by PoY may be purchased through the PoY platform, in accordance with the prices and modalities indicated therein.

All purchases are subject to the Cancellation and Rescheduling Policy, Billing and Refund Policy, and Data Privacy Policy described in the following sections, which form an integral part of these Terms and Conditions.

In order to complete a purchase, the user must expressly accept these Terms and Conditions during checkout by selecting the corresponding acceptance checkbox.

5. Cancellation and Rescheduling Policy

At PoY, we value commitment and organization throughout the personal development process. To ensure the proper functioning of sessions and mutual respect between clients and coaches, the following rules apply.

5.1. Right of Withdrawal (Online Purchases)

Pursuant to Portuguese Decree-Law no. 24/2014 of 14 February, the client has the right to withdraw freely from the contract within 14 consecutive days from the purchase date.

• To exercise this right, the client must communicate their decision unequivocally to PoY via email at [info@poy-powerofyou.com](mailto:info@poy-powerofyou.com) within the aforementioned period;
• By completing the purchase and accepting these Terms and Conditions, the client expressly requests the immediate commencement of service provision before the expiry of the withdrawal period;
• If the client exercises the right of withdrawal within the 14-day period, PoY shall be entitled to receive payment proportional to the services effectively provided up to the date on which the withdrawal is communicated, pursuant to Article 15(3) of Decree-Law no. 24/2014;
• The right of withdrawal ceases once the service has been fully performed, pursuant to Article 17(m) of the aforementioned Decree-Law;
• Where applicable, refunds shall be processed within a maximum period of 14 days following communication of withdrawal, using the same payment method used for the purchase.

5.2. Cancellation of Sessions by the Client

After the withdrawal period has expired, the following rules apply to the cancellation of scheduled sessions:

• Each session has a duration of 1 hour and is consumed within a single booking. A session cancellation is eligible for refund provided it is communicated at least 48 hours prior to the scheduled date and time;
• In the case of packages comprising multiple sessions, the client may cancel and obtain a full refund for sessions not yet completed, provided each session is cancelled at least 48 hours in advance. Sessions already completed or cancelled outside this period are non-refundable;
• The refund amount for unused sessions shall be calculated proportionally based on the price effectively paid for the package, taking into account any discounts applied at the time of purchase;
• Cancellations made less than 48 hours prior to the scheduled session are non-refundable and imply forfeiture of the respective session.

5.3. Rescheduling of Sessions by the Client

• Sessions may be rescheduled up to 24 hours before the scheduled time;
• Each client may reschedule a maximum of one session per month;
• If this limit is exceeded or if rescheduling is requested less than 24 hours in advance, the client shall forfeit the session without entitlement to refund.

5.4. Rescheduling by the Coach

Whenever unforeseen circumstances require a coach to reschedule a session, PoY shall offer the client the option to:

• Reschedule with the same coach on a new date; or
• Select another available coach according to the client’s preference.

5.5. Communication

All cancellation or rescheduling requests must be submitted through our platform or by email to [info@poy-powerofyou.pt](mailto:info@poy-powerofyou.pt) within the applicable deadlines.

6. Billing and Refund Policy

At PoY, we are committed to transparency and simplicity in our commercial practices. The following terms govern the billing and refund processes associated with our services.

6.1. Billing

• All services purchased through the PoY platform are invoiced at the time of purchase;
• Invoices shall be automatically issued using the information provided by the client and sent by email within up to 7 business days following payment;
• Should any invoice corrections or additional information be required, the client must contact us via [info@poy-powerofyou.pt](mailto:info@poy-powerofyou.pt) within a maximum period of 7 days following the purchase.

6.2. Payment Methods

• We accept the main digital payment methods available at checkout;
• All payments are securely processed through certified payment providers.

6.3. Refunds

Refunds are subject to the rules set out in the Cancellation and Rescheduling Policy (Section 5), as well as to the Right of Withdrawal provided under Section 5.1, namely:

• Only sessions cancelled more than 48 hours in advance are eligible for refund outside the withdrawal period;
• In the case of plans or packages including multiple sessions, the client is entitled to a full refund for sessions not yet completed, provided each session is cancelled at least 48 hours in advance, under the terms of Section 5.2. In situations involving technical issues attributable to PoY or prolonged coach unavailability, PoY shall issue a full refund for the affected sessions regardless of the notice period;
• Refunds arising from the exercise of the right of withdrawal are governed by Section 5.1.

6.4. Processing Time

• Approved refunds shall be processed within up to 10 business days using the original payment method;
• Refunds processed under the right of withdrawal shall be completed within a maximum period of 14 days following notification of withdrawal.

7. Data Privacy Policy

At PoY, your privacy is a priority. We collect, process, and protect your personal data transparently and responsibly, in accordance with the General Data Protection Regulation (GDPR).

7.1. Data Controller

Personal data is processed by PoY — Power of You, as the entity responsible for its collection and use.

7.3. Purpose of Processing

• Scheduling and delivery of coaching sessions;
• Continuous improvement of the services provided;
• Client communication (support, notifications, and reminders);
• Internal statistics and analytics (anonymized);
• Service billing.

7.4. Data Sharing

Your data may be shared with coaches contracted by PoY exclusively for the purpose of providing the contracted services. Such coaches are bound by confidentiality obligations and may not use the data for any other purpose.

7.5. Data Retention

Data shall be retained only for the period necessary to fulfil the purposes for which it was collected, or until the user requests its deletion, subject to applicable legal retention periods.

7.6. Data Subject Rights

The user may, at any time, exercise their rights of access, rectification, erasure, restriction, objection to processing, and data portability. To do so, users should contact us at [info@poy-powerofyou.com](mailto:info@poy-powerofyou.com).

7.7. Security

We implement appropriate technical and organizational measures to protect your data against loss, unauthorized access, or misuse.

7.8. Informed Consent Notice

By submitting personal data through the PoY platform and scheduling coaching sessions, the user declares that they:

• Understand that their personal data and information shared during sessions may be used to personalize the coaching experience and improve services;
• Acknowledge that only the coaches assigned to their sessions shall have access to their information, under strict confidentiality obligations;
• Authorize the processing of personal data for the purposes described in this Privacy Policy;
• Understand that they may withdraw this consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal.

8. Intellectual Property

All content available on the PoY website and platform — including texts, images, graphics, logos, trademarks, documents, and layouts — is the property of PoY or duly authorized third parties. Any use, reproduction, or distribution without prior authorization is expressly prohibited.

9. Disclaimer of Liability

PoY makes every reasonable effort to ensure the accuracy and timeliness of the information provided but does not guarantee the absence of errors or omissions.

PoY shall not be held liable for:

• Decisions made based on the information provided;
• Errors or interruptions affecting the operation of the website or platform;
• Third-party content or external websites referenced through links.

10. Amendments to the Terms and Conditions

PoY reserves the right to amend these Terms and Conditions at any time. Any amendments shall be published on the website, and continued use of the website or platform following such amendments shall constitute acceptance thereof.

These Terms and Conditions shall be governed by Portuguese law. Any disputes arising from their application or interpretation shall fall under the jurisdiction of the Portuguese courts, without prejudice to alternative consumer dispute resolution mechanisms provided under Law no. 144/2015 of 8 September.

In the event of a consumer dispute, the client may resort to CNIACC — National Centre for Consumer Conflict Information and Arbitration ([www.cniacc.pt](http://www.cniacc.pt)), or to another Consumer Arbitration Centre competent within the relevant territory, pursuant to the list published by the Portuguese Consumer Directorate-General ([www.consumidor.pt](http://www.consumidor.pt)).
